LegalScreen Inc. ("LegalScreen", "we", "us", or "our") respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes the types of information we may collect from you or that you may provide when you visit the website legalscreen.com (our "Website") or use our background screening services (the "Services"), and our practices for collecting, using, maintaining, protecting, and disclosing that information.

We operate as a Consumer Reporting Agency (CRA) under the federal Fair Credit Reporting Act (FCRA). As such, our handling of data is also governed by federal and state regulations designed to specific consumer protections.

2. Information We Collect

We collect information by which you may be personally identified, such as name, postal address, e-mail address, telephone number, and social security number ("personal information").

  • From Clients (Employers/Landlords): Business contact information, billing details, and information provided about applicants for the purpose of a background check.
  • From Consumers (Applicants): PII provided directly via our Authorization Forms, including full name, date of birth, SSN, driver’s license number, address history, and education/employment history.
  • From Public Records: We aggregate data from courts, government agencies, and other public repositories.

3. How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal information:

  • To present our Website and its contents to you.
  • To provide the background screening reports requested by our Clients, strictly in accordance with the FCRA.
  • To verify the accuracy of the information provided (e.g., verifying a degree with a university).
  • To notify you about changes to our Website or any products or services we offer or provide though it.
  • To comply with legal obligations, including dispute resolution and regulatory filings.

We DO NOT sell, rent, or trade your personal information to third parties for marketing purposes. Your data is used solely for the purpose of the background check.

4. Data Security

We have implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure.

  • Encryption: All sensitive data (SSN, DOB) is encrypted at rest using AES-256 standards and in transit using TLS 1.2+.
  • Access Controls: Access to PII is restricted to authorized employees who need the information to perform a specific job (e.g., billing or customer service).
  • Physical Security: Our servers are housed in secure, SOC2-compliant data centers with 24/7 monitoring.

5. Information Sharing

We may disclose personal information that we collect or you provide as described in this privacy policy:

  • To our authorized Clients (the Employer or Landlord) who ordered the report, after certifying a permissible purpose.
  • To contractors, service providers, and other third parties we use to support our business (e.g., a court runner in a specific county), who are bound by contractual obligations to keep personal information confidential.
  • To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

6. Data Retention

We retain background check reports and related data for a minimum of five (5) years to comply with the statute of limitations under the FCRA and other applicable laws. After the retention period expires, data is securely destroyed in accordance with our data destruction policy (e.g., digital wiping).

7. Consumer Rights (FCRA)

As a consumer, you have specific rights under the Fair Credit Reporting Act:

  • Right to Review: You may request a copy of your file ("Full File Disclosure") at any time.
  • Right to Dispute: If you believe information in your report is inaccurate or incomplete, you may file a dispute. We will reinvestigate the item free of charge, usually within 30 days.
  • Right to Place a Freeze: You have the right to place a "security freeze" on your report.

8. California Privacy Rights (CCPA/CPRA)

If you are a California resident, the CCPA provides you with specific rights regarding your personal information. However, please note that personal information collected pursuant to the FCRA is generally exempt from the CCPA.

For non-FCRA data (e.g., marketing data if applicable), you have the right to request access to and deletion of your personal information. To make such a request, please contact us using the methods below.
