2. FCRA Compliance Certification

LegalScreen relies on information from third-party sources to prepare background screening reports. These reports are "Consumer Reports" as defined by the Fair Credit Reporting Act (FCRA) (15 U.S.C. § 1681 et seq.).

You certify and agree to the following:

• You will provide the consumer (applicant) with a clear and conspicuous disclosure, in writing, that a consumer report may be obtained for employment purposes.
• You will obtain the consumer's written authorization before ordering any report.
• You will strictly follow the "Pre-Adverse Action" and "Adverse Action" procedures if you intend to deny employment based in whole or in part on the report.
• You will not use the information in violation of any applicable federal or state equal employment opportunity law or regulation.

3. Permissible Purpose

Under the FCRA, it is a federal crime to order a consumer report without a "Permissible Purpose." You certify that you are ordering reports strictly for Employment Purposes (hiring, promotion, retention) or Tenant Screening.

Ordering a background check on yourself, a neighbor, a celebrity, or anyone else out of "curiosity" is strictly prohibited and constitutes a violation of federal law.

4. User Obligations & Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Notify us immediately of any unauthorized use of your account.
• Ensure that only authorized personnel within your organization have access to the reports.
• Securely destroy physical or digital copies of reports once they are no longer needed for the decision-making process.

5. Warranties and Disclaimers

Accuracy Disclaimer: LegalScreen does not create the records found in the reports; we aggregate them from public sources (courts, DMVs, etc.). Public records may contain errors, be incomplete, or not be up to date.

Disclaimer of Warranties: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE DO NOT GUARANTEE THAT THE DATA WILL BE ERROR-FREE.

6. Indemnification

You agree to indemnify, defend, and hold harmless LegalScreen Inc., its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected with:

• Your violation of these Terms or the FCRA.
• Your failure to obtain proper authorization from the consumer.
• Your improper use of the consumer reports.
• Your negligence or willful misconduct.

7. Termination

We reserve the right to suspend or terminate your account immediately, without notice, if we suspect you have violated these Terms, the FCRA, or if we detect suspicious activity (e.g., bot-like behavior or unauthorized access attempts).

8. Changes to These Terms

We may update these Terms from time to time to reflect changes in the law or our business practices. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
